3. The injured party is guaranteed certain compensation for lost wages and medical claims, and in return gives up the right to sue the employer for negligence or wrongful acts. However, if a third party (i.e., someone other than the employer) was responsible for the accident, the injured party still has the right to bring a separate claim against that party.

The nature of the work is inconsequential, as long as the injuries were sustained on the job. Workers compensation can be claimed by a house painter whose back breaks in a fall from a high ladder or by a secretary who suffers from carpal tunnel syndrome.
